Petitioner has filed this writ petition seeking following reliefs:- 10.1 That, the Hon’ble Court may kindly be pleased to direct the respondents to include the name of the petitioner in the Gradation List of Associate Professors working under the Medical Education Department. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondents to consider the petitioner for promotion on the post of Professor. 10.3 Any other relief which this Hon’ble Court may deem fit and proper in the interest of justice, equity and good conscience.” 2. Learned counsel for petitioner submits that after publication of the provisional gradation list, petitioner along with three others have raised an objection. The objections submitted by petitioner and other three persons have been forwarded to Commissioner, Medical Education on 26.09.2025, however, till date no decision has been taken. 3. Learned counsel for State would submits that according to his instructions the objection raised by petitioner and other three persons are under consideration and appropriate orders will be passed, in accordance with law and further submits that according to the instructions received the decision can be taken within a period of three weeks. He submits that an affidavit in this regard has been filed by the Commissioner, Medical Education in which also it is stated that the 3 / 4 claim of petitioner will be considered as early as possible and strictly in accordance with law while keeping in mind the rules and regulation. 4. Ms. Dangi submits that she has filed an application for intervention today itself on the ground that the intervenor is placed at serial no. 1 in the preliminary gradation list of Assistant Professor and if the claim of petitioner gets accepted then it will affect the right of intervenor. 5. The submission of Ms. Dangi is objected by counsel for petitioner as also by the State counsel stating that on the objection called for the petitioner has submitted objection before the authority which is still to be considered and appropriate orders will be passed in accordance with law and, therefore, the objection at this stage is premature. 6. Heard learned counsel for the respective parties. 7. So far as it relates to the objection of intervenor on the claim of petitioner is considered, petitioner being an employee of respondent department coming across the provisional gradation list has submitted, an objection, and it is for the respondent authorities to consider and decide the objection following due process of law, considering the rules and regulations applicable to the facts of the case. The decision is yet to be taken and therefore, in the opinion of this Court at this stage, the intervenor is having no locus to intervene in this matter. 8. With regard to the claim of petitioner and the affidavit filed by Commissioner, Medical Education and submission made by learned State counsel that the objection raised by petitioner is under consideration and decision can be taken within a period of three weeks, I find it appropriate to dispose of this writ petition directing respondent authorities to consider and take decision on the objection 4 / 4 filed by petitioner along with three other employees, expeditiously, preferably within the period of four weeks, in accordance with law. 9. It is for the counsel for State to inform the respondent authorities about the order passed by this Court . 10. Intervenor will be at liberty to file appropriate proceedings if he feels aggrieved with the decision taken by the respondent authorities. 11.
