……for the State. Learned senior advocate appearing for the petitioner submits that the complaint was initiated in respect of incidents relating to 2021 and subsequent events. The same according to the learned senior advocate is because of change of administration. Learned advocate appearing for the defacto complainant opposes the prayer and submits that the complainant and her
2 family members were severely tortured by the present petitioner and his associates. Whole of the house was ransacked and they could not complain because of the influence and clout of the present petitioner and his associates. Learned advocate for the State opposes the prayer for anticipatory bail and submits that there are statements of witnesses. However, so far as the C.C.T.V. footage is concerned according to the learned advocate for the State the same are not in a proper shape for identification. Be that as it may, I have considered the complaint although reasonable offences have been made out, but specific accusation against the present petitioner is absent. Having regard to the same, I am of the view that custodial detention of the petitioner in the facts may not be warranted. Accordingly prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner, namely Ashutosh Das be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress petitioner shall make himself available before the Investigating Officer within a period of 10 days.
The Investigating Officer will
3 thereafter fix subsequent dates for appearance of the present petitioner for the sake of investigation of the present case. With the aforesaid observations CRM (A) 1637 of 2026 is allowed. Pending application(s), if any, is consequently disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
