“10.1 That, this Hon'ble Court may kindly be please to issue appropriate writ/order/direction to the respondent authority to grant GPF Payments of the petitioner for the period of 19th April 1975 to Financial Financial Year 1978-79-79, in the interest of justice. 10.2 That, this Hon'ble Court may kindly be please to issue appropriate writ/order/direction to the respondent authority to pay all the consequential benefit to the petitioner for the period of 19th April 1975 to Financial Financial Year 1978-79-79, in the interest of justice. 10.3 That, this Hon'ble Court may kindly be please to issue appropriate writ/order/direction to the respondent authority to pay interest of 18% to the petitioner for the period of 19th April 1975 to Financial Financial Year 1978-79-79 for causing delay and latches in granting the amount. 10.4 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner together with cost of the petition.”
2. Upon perusal of the records, it appears that earlier, the petitioner had filed a writ petition bearing WPS No. 475/2024, seeking a direction to the respondent authorities to consider and decide his claim regarding payment of GPF.
Vide order dated 29.01.2024, this Court disposed of the said writ petition with a direction to the respondent authorities to consider and decide the claim of the petitioner. Thereafter, the petitioner filed a contempt petition bearing CONT No. 1131/2025 against the respondents. During the pendency of the said contempt petition, an amount of Rs. 3 7,24,331/- was released in favour of the petitioner on 11.05.2026. Vide order dated 13.05.2026, the contempt petition was dropped on the submission made by learned counsel for the petitioner that the order passed by this Court in WPS No. 475/2024 had been duly complied with. The present writ petition has now been filed by the petitioner disputing the quantum of the GPF amount released in his favour. 3. It appears from the pleadings of the petitioner that the grievance raised in the present writ petition relates to the quantum of GPF amount paid to him. Such factual issues can appropriately be considered and adjudicated upon by the High Power Pension Redressal Committee. 4. In view of the above, the office of the Advocate General is directed to send the case to the Committee, within a period of 15 days from the date of receipt of a copy of the petition from the petitioner and this order. The Committee shall consider and pass a reasoned order within a further period of 3 months, in accordance with law, after affording proper opportunity of hearing to the parties. The petitioner and the officers concerned may file additional documents, if necessary. The entire exercise, including retiral dues of the employee and other pensionary benefits, if any, to the petitioner be completed within a period of three months from the date of receipt of a copy of this order. 4
5. The petitioner shall supply extra copy of the petition to learned counsel appearing for the State/respondents for forwarding the same to the Committee. 6. Accordingly, the writ petition is disposed of as withdrawn with the aforesaid liberty. SD/-
