Affidavit of service filed by the petitioner is taken on record. The petitioner who is the Pradhan of Kasiyadanga Gram Panchayat has assailed the no confidence motion submitted by the private respondents/members of the Panchayat on 17th July, 2026 on the ground that it contains a stigma against the petitioner and cannot be sustained.
Learned counsel for the private respondents denies and disputes the allegation made by the petitioner. It appears that the no confidence motion was submitted by the private respondents on 17th July, 2026 and date of meeting has been fixed on 3rd August, 2026 by the Prescribed Authority by a notice issued on 24th July,
2026. The motion records that the members have lost confidence on the Pradhan due to her administrative functions and performance. The word “stigma” has been defined in Mitra’s Legal and Commercial Dictionary, Sixth Edition as something
2 that detracts from the character or reputation of a person, a mark, sign, etc. indicating that something is not considered normal or standard. It is a blemish, defect, disgrace, disrepute, imputation, mark of disgrace or shame and mark or label indicating deviation from a norm. In the context of an order of termination or compulsory retirement of a government servant stigma would mean a statement in the order indicating his misconduct or lack of integrity. In the present case, the expression used in the no confidence motion cannot be said to be stigmatic. The private respondents/members have only expressed their loss of confidence on the petitioner in view of her administrative functions. The motion cannot be said to be invalid/illegal on that score. The writ petition is devoid of any merit and is accordingly dismissed. Since the meeting is scheduled on 3rd August, 2026, the Inspector in charge, Raghunathganj Police Station is
directed to render necessary assistance to the Prescribed Authority so that the meeting is held peacefully and without any disturbance from any corner whatsoever. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
