……for the State. Learned advocate appearing for the petitioners submits that the subject matter of the case relate to alleged recovery of 929 Gms. of Brown Sugar. However, so far as the present petitioner is concerned he has been implicated on the basis of statement of co-accused. Earlier there were directions by this Court, accordingly reports have been submitted. Reports do not reflect that there are any criminal antecedents or any money trial or CDR available so far as the conspiracy between the present petitioner and the other accused persons who have been implicated in this case. 2
Having regard to the complicity and the fact that charge sheet has already been submitted, I am of the view custodial detention of the petitioners may not be warranted. As such prayer for anticipatory bail of the petitioners is allowed. As such, I direct that in the event of arrest, the petitioner namely, (1) Md. Isha Sk, (2) Haiul Sk @ Hayul Sk. be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge sheet has already been submitted, this order of anticipatory bail will remain in force for a period of 6 weeks. Report submitted by the State in respect of appearance of the Investigating Officer as also the other report relating to money trail and previous antecedents be kept with the record. With the aforesaid observations, CRM (A) 1633 of 2026 is allowed. Pending application(s), if any, is consequently disposed of. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
