1. Heard Mr. M.U. Mondal, learned counsel for the petitioner.
2. The present contempt petition is filed alleging
Page No.# 2/2 willful and deliberate violation of the order dated 05.08.2022, passed in WP(C) No.4979/2022.
3. By the aforesaid order, the Secretary, Elementary Education Department was directed to consider the petitioner’s representation dated 19.07.2022 and to dispose of the same by a speaking order in accordance with law within a period of 6 (six) weeks from the date of receipt of the said order.
4. Today when the matter is listed, Mr. PK Borah,
learned counsel for the respondent has produced an order dated 22.03.2023, by which the appeal of the petitioner was decided by sustaining the merger order of merging M. Buchir Char LPS with Pub Sarak Para Moktab LP School under Bilasipara Education Block, Dhubri.
5. In view of the aforesaid, in the opinion of this court, the order dated 05.08.2022 passed in WP(C) No.4979/2022, stands complied with.
6. It is needless to say that the petitioner shall be at liberty to assail such appellate speaking order before the appropriate forum, if so advised.
7. A copy of the order dated 22.03.2023 is kept on record.
