Balial. …for the de facto complainant. Learned advocate appearing for the petitioner submits that the petitioner has been implicated in the instant case over issue relating to demand of salary. Learned advocate appearing for the de facto complainant opposes the prayer for anticipatory bail and refers to specific averments made in the FIR. Learned advocate for the State produces the case diary and draws the attention of the Court to the statement of the victim under Section 183 of the BNSS. 2
I have taken into account the merits of the case. The conduct of the petitioner may not be approved. However, custodial detention in the instant case for the sake of investigation is unwarranted. As such, the prayer for anticipatory bail of the petitioner is allowed. Accordingly, in the event of arrest, the petitioner, namely, Ajoy Krishna Mistri shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress, petitioner shall not enter into the jurisdiction of Ranaghat Police Station except for the purposes of attending the court proceedings. Petitioner shall meet with the investigating officer of the case within a period of 10 days from date and thereafter make himself available as and when called for by the investigating officer of the case till the charge-sheet is submitted before the jurisdictional court. The aforesaid conditions will be subject to modification as per requirement by the learned special court in seisin of the case. With the aforesaid observations, CRM(A)1658 of 2026 is allowed. Service report submitted by the State be kept with the record.
