ORAL ORDER Accused Nos.1 and 2 in Crime No.146/2026 registered by Parappana Agrahara Police Station, Bengaluru for offences punishable under Sections 126(2), 324(4), 329(3), 351(2), 351(3), 352 and 3(5) of BNS, 2023, are before this Court, in this petition, filed under Section 482 of BNSS, 2023, seeking anticipatory bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.146/2026 was registered for the aforesaid offences against the petitioners herein and others based on the first information dated 30.03.2026 received from Radha, who is the authorized representative

of a car showroom known as Dakshin Honda at Singasandra Bengaluru. Apprehending arrest in the said case, petitioner has filed Crl.Misc.No.3598/2026 before the jurisdictional Sessions Court, which was rejected on
02.05.2026. Therefore, they are before this Court.

In the first information, dated 30.03.2026, it is alleged that, on 28.03.2026, at about 08.00 p.m., accused persons trespassed into the property belonging to the complainant, along with a crane and shifted the cars which were parked inside and, as a result, damage was caused to the said cars. When the accused persons were questioned, they allegedly had abused the first informant and also criminally intimidated her. They also have blocked the road to reach the said property and on 29.03.2026 and 30.03.2026 also they have committed similar acts and it is under these circumstances, FIR was registered on 30.03.2026.

Learned counsel for the petitioners submits that, there is a civil dispute between the parties in O.S.No.642/2026 and the order of ex-parte temporary injunction granted in the said suit was got vacated by the petitioners herein, who are the defendants in the said suit. Subsequently, the present complaint is filed making baseless and omnibus allegations, only with the intention to harass the petitioners.
5. Be that as it may, undisputedly, there is a civil dispute between the parties and allegations found in the first information are not grave in nature. Petitioners have undertaken to co-operate with the police for the purpose of investigation. Under the circumstances, the following:
ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No. 146/2026 registered by Parappana Agrahara Police

Station, Bengaluru for offences punishable under Sections 126(2), 324(4), 329(3), 351(2), 351(3), 352 and 3(5) of BNS, 2023, subject to the following conditions: (i) The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. (ii) Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. (iii) Petitioners shall not tamper with the prosecution witness and they shall co-operate with the police for investigation and appear before them whenever called upon.
