This is the 1st bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the Applicants who have been arrested in connection SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.08.14 19:14:11 +0530 2 with Crime No.18/2026 registered at Police Station – Champa, Janjgir-Champa (C.G.), for the offences under Sections 140, 109(1), 311, 61(2), 111(1) and 3(5) of BNS as also under Sections 25 and 27 of Arms Act. 2. Facts of the case are that complainant Harish Dewangan, who was working as a Supervisor with M/s Arjun Industries, Champa, alleged that on 09.01.2026, after collecting an amount of Rs.20,18,700/- from different firms, he was returning on motorcycle bearing registration No. CG-11-AW- 5541 when, at about 3:30 p.m., near a pond at village Kosmanda, two unknown persons travelling in a black- coloured car bearing registration No.CG-11-BN-13 intercepted him. It is alleged that they threw chilli powder into his eyes, forcibly took him inside the car and assaulted him, whereupon he was taken to Mainpat and left near the Selfie Point at about 9:00 p.m. The complainant further alleged that 4-5 persons were present in the car and had assaulted him. Thereafter, he returned home after taking assistance at Kapu Bus Stand and after undergoing treatment, lodged the FIR on 15.01.2026. Accordingly offences were registered against the Applicants Hence, this application. 3. Learned Counsel for the Applicants submits that the Applicants are innocent and have been falsely implicated in 3 the present case. It is further submitted that the Applicants have not caused any injury to the complainant and have been implicated merely on suspicion. He further submits that after filing of the charge-sheet, the complainant has been examined before the learned Trial Court in Sessions Case No. 62/2026 and has not supported the prosecution case. It is also submitted that the Applicants are in custody since 19.01.2026 and 16.01.2026 respectively and the trial is likely to take considerable time for its conclusion, therefore, they may be enlarged on bail. 4. On the other hand, learned State Counsel opposes the bail application. 5. Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature of allegations, the serious allegation of forcibly taking the complainant in a car after throwing chilli powder in his eyes and assaulting him, the fact that the Applicants are alleged to have participated in the commission of the offence, and without further commenting anything on the merits of the case, this Court is not inclined to extend the benefit of bail to the Applicants. 6. Accordingly, the bail application of the Applicants – Sunil Kurre and Amir Miri @ Bholu involved in Crime No. 18/2026 4 registered at Police Station – Champa, Janjgir-Champa (C.G.), for the offences under Sections 140, 109(1), 311, 61(2), 111(1) and 3(5) of BNS as also under Sections 25 and 27 of Arms Act is hereby rejected. 7.
