ORAL ORDER
1. Proceedings are initiated against the petitioner before respondent no.3 for recovery of a loan at the behest of respondent no.2-Society. Aggrieved by the same, the present writ petition is filed. 2. The case of the petitioner is that, he has neither borrowed any loan nor has he stood as guarantee for any borrower, nor has he given any collateral

security for any loan borrowed by any person. Inspite of it, his name is dragged into the dispute pending on the file of respondent no.3. It is his contention that a frivolous case is filed against him only with an ulterior motive of hampering his future prospects in the election he has sought to contest. 3. Admittedly, no order has been passed against the petitioner by respondent no.3. A proceeding has been initiated against the petitioner for recovery of loan.
If petitioner is of the opinion that he is not liable to pay the same, he is always having the necessary liberty to defend himself in the proceedings before respondent no.3. A writ cannot lie in this regard. 4. For the aforementioned reasons, the writ petition is hereby dismissed. Pending I.As., if any, stand disposed of. Sd/- (M.I.ARUN) JUDGE
