JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.7 in S.C.No.61/2026, pending before the Court of III Additional District and Sessions Judge at Kolar (sitting at KGF), arising out of Crime No.4/2026 registered by Budikote Police Station, KGF, for offence punishable under Section 310(2) of BNS, 2023 is before this Court, in this petition, filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.4/2026 was registered by Budikote Police Station, KGF, for offence punishable under Section 309(4) of BNS, 2023 against two unknown persons based on the first information dated 10.01.2026 received from Naveen Kumar, who is the alleged victim in the present case. During the course of investigation, petitioner herein - 3 - HC-KAR CNR: KAHC010406622026 NC: 2026:KHC:39467 CRL.P No. 8601 of 2026 was arrested on 14.02.2026 and remanded to judicial custody. After completing investigation, charge sheet is filed against seven persons and petitioner is arrayed as accused No.7 in the charge sheet. His bail application filed before the Trial Court in S.C.No.61/2026 was rejected on 04.06.2026. Therefore, he is before this Court. 3. Accused Nos. 1 and 6 in the present case, who had approached this Court in Crl.P.Nos.8596/2026 and 3773/2026, have been granted regular bail by this Court. In paragraph No.5 of the order passed in Crl.P.No.8596/2026, this Court has observed as follows: “5. In the charge sheet, allegation of intercepting the vehicle of the first informant and thereafter escaping along with the vehicle with the cash which was kept in the said vehicle is found as against accused Nos. 4 and 5. Petitioner and other accused persons allegedly had conspired with the aforesaid accused to commit robbery of the amount which the first informant was transporting for the purpose of depositing in the bank.” - 4 - HC-KAR CNR: KAHC010406622026 NC: 2026:KHC:39467 CRL.P No. 8601 of 2026 4. Investigation of the case is now completed and charge sheet has been filed. It is not in dispute that, petitioner has no other criminal antecedents. Under the circumstances, the following: ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.61/2026, pending before the Court of III Additional District and Sessions Judge, at Kolar arising out of Crime No. 4/2026 registered by Budikote Police Station, KGF, for offence punishable under Section 310(2) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - HC-KAR CNR: KAHC010406622026 NC: 2026:KHC:39467 CRL.P No. 8601 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
