In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sagarpara Police Station case no. 93 of 2026 dated 12.02.2026 under Sections 21(C)/29 of the NDPS Act. And In the matter of : Sujan Sekh @ Sujan Molla. ……Petitioner. Mr. Arnab Chatterjee Mr. Avik Ghosh
.....for the Petitioner. Mr. Subrata Makherjee Mr. Sanjib Das
……for the State. Learned advocate appearing for the petitioner submits that the subject matter of the case relate to alleged recovery of 1540 bottles of Eskuf cough syrup from the possession of other accused persons and the present petitioner has been implicated in the present case on the basis of statement of co-accused and there has been no recovery from the available hideouts of the present petitioner also in connection with the instant case. Learned advocate appearing for the State opposes the prayer for anticipatory bail and submits a report. In order to substantiate that there is a criminal antecedent of the present petitioner which refers to Islampur Police Station case no. 306/2020. To controvert such submissions learned advocate appearing for the petitioner has produced judgment of the said case wherein the present petitioner was acquitted. 2 Having considered the aforesaid, I am of the opinion that so far as the present case is concerned, petitioner’s custody is unwarranted. As such, the prayer for anticipatory bail of the petitioner namely, Ashutosh Das is allowed. Accordingly, I direct that in the event of arrest, the petitioner shall furnish bond subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Learned advocate appearing for the petitioner submits that petitioner indents to appear before the jurisdictional Court within a period of four weeks. Accordingly, this order of anticipatory bail will remain valid for a period of six weeks from date. With the aforesaid observations, CRM (A) 1640 of 2026 is allowed. Pending application (s), if any, is consequently disposed of. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
