31/07/2026 D/L – 30 Court No.35 S. Kundu Allowed
C.R.M.(A) 1616 of 2026
In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Khanakul P.S case no. 92 of 2025 dated 07/02/2025 under Sections 316(2)/318(4)/61(2) of the BNS. In the matter of: Srabani Batabyal & Ors. ...Petitioners. Mr. Avijit Ganguly …for the petitioners. Mr. Brajesh Jha Ms. Koel Mukherjee …for the State.
Learned advocate for the petitioners submits that genesis in the present dispute relates to long standing civil dispute. There has been civil cases and criminal cases both at the behest of the petitioners, as also by the de-facto complainant. Learned advocate for the State opposes the prayer for anticipatory bail. I have taken into account the genesis of the dispute and the offences complained of are magistrate triable offence. Having regard to the overall circumstances, although a case for investigation may have been made out but custodial detention of the petitioners is unwarranted. Thus, prayer for anticipatory bail is allowed. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- each with two

sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also abide by the conditions laid down under Section 438(2) of the Cr. P.C/482(2) of the BNSS. As the investigation of the case is in progress, petitioner no. 3 will make himself available within a period of 10 days and thereafter as and when called for by the I.O. So far as the petitioner nos. 1 and 2 are concerned, they shall make themselves available when approached by the I.O. Accordingly, the application for anticipatory bail being CRM(A) 1616 of 2026 is allowed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
