In the matter of : Firoz Sk @ Firoz Sekh
… Petitioner(s)
Md. Wasim Akram Ms. S. Parveen
… for the petitioner(s)
Mr. Imran Siddiqui
… for the State-respondent(s)
Report submitted by the State be kept with the record. The report reflects that there are no criminal antecedents and/or any Call Data Records and/or any money trail is available so far as the present petitioner is concerned. However, there was recovery of 5 kg of brown sugar in the present case in respect of the two seizures being effected and the complicity of the present petitioner as is reflected is primarily on the basis of statement of a co- accused. Charge-sheet has already been submitted before the learned jurisdictional court.
2 Having regard to the same, I am inclined to grant anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Firoz Sk @ Firoz Sekh] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has been submitted before the learned jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 1623 of 2026 is disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
