Apprehending danger to his life and liberty, petitioner has filed a petition under Article 226/227 of the Constitution of India with a prayer to direct official respondents to protect his life and liberty from the private respondents, while deciding representation dated 07.07.2026.

Learned counsel for the petitioner submits that petitioner and respondents No.5, 6 were neighbours residing across the street. They had disputes with each other. Respondent No.5 had links with respondent No.4- SHO, Police Station, Dabwali who frequently visited their home as evidenced by photographs (Annexure P-2). Respondent No.4 threatened petitioner and his family on 24.04.2026 for picking up quarrels with respondents No.5 and
6. Thereafter, false FIR No.124 dated 24.04.2026 was registered in Police Station, City, Mandi Dabwali under Sections 115, 126, 3(5) and 351(2) of Bharatiya Nyaya Sanhita (B.N.S.), 2023. Petitioner thus, feared for his life and liberty at the hands of respondent No. 4 to 6. A representation in this regard was moved to official respondents but no action was taken.

3. Notice of motion.

Mr. Kunwarbir Singh, AAG Punjab accepts notice on behalf of the official respondents. He opposes the prayer submitting that petitioner was facing trial in a criminal case and there was no threat to his life and liberty.

Petitioner is aggrieved with registration of FIR No.124 dated 24.04.2026 under Sections 115, 126, 3(5) and 351(2) BNS registered against him in Police Station, City Mandi Dabwali and alleges that the FIR is false, fabricated registered on complaint of respondent No.5 with the intervention of respondent No.4-SHO, Police Station City Dabwali. Concededly, the FIR is pending investigation. Mere registration of FIR against the petitioner cannot be constituted as a threat to his life and liberty. Investigation in the matter is yet pending and falsity of the FIR would be determined by the competent Court, after conclusion of trial. There being no ground to issue any directions in the matter, the petition stands dismissed.
