31/07/2026 D/L – 74 Court No.35 S. Kundu Allowed C.R.M.(A) 1720 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Gopalnagar P.S case no. 352 of 2026 dated 06/06/2026 under Sections 384 of the IPC. In the matter of: Soumendra Nath Dutta @ Soumen Dutta ...Petitioner. Mr. Dipanjan Chatterjee Mr. Md. Sabbir Biswas Mr. Jyotirmay Talukdar Mr. Triptimoy Talukder …for the petitioner. Mr. Abir Bhattacharyya …for the de-facto complainant. Mr. Somnath Adhikary Ms. Rima Banerjee …for the State. Learned advocate for the petitioner submits that the petitioner has been victimized because of his political association and has been asked to face the charges in a criminal case after there was change in administration. Learned advocate for the de-facto complainant is present. Learned advocate for the State opposes the prayer for anticipatory bail and submits that substantial materials are appearing from the statement of the different witnesses. I have taken into account the genesis of the case particularly the letter of complaint and the fact that the incident complained off initiates from the year 2022. 2 Having considered the aforesaid, I am of the view although the investigation should continue but custodial detention of the petitioner may not be warranted in the facts of the case. Thus, prayer for anticipatory bail is allowed. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also abide by the conditions laid down under Section 438(2) of the Cr. P.C/482(2) of the BNSS. Since the investigation of the case is in progress, the petitioner shall make himself available before the I.O within a period of 10 days and thereafter, the I.O will fix necessary dates for appearance of the petitioner for the sake of investigation. Accordingly, the application for anticipatory bail being CRM(A) 1720 of 2026 is allowed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
