Robiul Islam Sk. Jayed Hossain Mr. Raja Mondal Masooq Rahman …. For the Petitioners Mr. Prasanta Naskar Ms. Pinky Ghosh …. For the State
Affidavit of service filed on behalf of the petitioners is taken on record. The Pradhan/8th respondent is not represented despite service. The petitioners who are the members of Margram Gram Panchayat submitted a no confidence motion for removal of the Pradhan of the Panchayat before the Prescribed Authority on 8th July, 2026 pursuant to which the meeting was fixed by the Prescribed Authority on 23rd July, 2026 by a notice issued on 15th July,
2026. In the meantime, the Pradhan/private respondent approached this Court in a writ petition being WPA 17684 of 2026 assailing the notice issued by the Prescribed Authority on 15th July, 2026. The writ petition was dismissed by an order passed on 22nd July,
2026. By the said order this Court directed the Officer in Charge, Khargram Police Station to render necessary assistance to the Prescribed Authority for holding the meeting peacefully. The said Officer in Charge, by a
2 letter issued on 20th July, 2026 expressed his inability to provide such assistance for which the meeting was postponed by a notice issued on 22nd July, 2026. On the same date, the Pradhan tendered her resignation before the Prescribed Authority. However, the resignation was withdrawn by a letter issued by the Pradhan on 24th July, 2026. The petitioners seek a direction upon the Prescribed Authority to convene the meeting and conclude the proceeding in accordance with law. Since the meeting has been postponed by the Prescribed Authority for reason beyond his control, the time limit prescribed in Section 12(10) of the West Bengal Panchayat Act shall stand extended correspondingly (MAT 992 of 2022 dated 15th July, 2022). In view of the above, the Prescribed Authority and the Block Development Officer, Khargram Block, being the 5th respondent herein, is directed to convene the meeting within 10 days from the date of communication of this order and take the proceeding to its logical conclusion at the earliest, in accordance with law.
The Officer in Charge, Khargram Police Station, being the 6th respondent herein, is directed to render necessary assistance to the 5th respondent so that the meeting is held peacefully without any disturbance from any corner whatsoever. 3 The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
