PP --- 03/07.04.2026 Heard the learned counsels appearing on behalf of the parties. 2. A counter-affidavit has been filed during the court proceedings, which is taken on record. 3. Learned counsel for the petitioner submits that the petitioner is in custody since 18.11.2025 in connection with Deoghar (Cyber) P.S. Case No. 150 of 2025, registered under Sections 111(2)(b), 111(3), 111(4), 319(2), 318(4), 338, 336(3), 340(2) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and sections 66(B), 66(C), 66(D) and 84(C) of the Information Technology Amendment Act, 2008, now pending in the court of learned Additional Sessions Judge-II-cum-cyber-crime, Deoghar. 4. Learned counsel for the petitioner further submits that the petitioner is in custody since 18.11.2025 and he has no criminal antecedent. He submits that one phone with SIM and one additional SIM has been recovered and out of them, one SIM does not stand in the name of the petitioner. 5. Learned counsel for the petitioner has also submitted that no case of organized crime is made out against the petitioner as no cyber link has been found with other co-accused persons. 6. Learned counsel for the petitioner has further submitted that number of co-accused persons namely, Amit Kumar Das, Vikram Kumar Das and Anand Kumar Das have been enlarged on bail by co-ordinate Benches of this Court vide orders dated 27.02.2026 passed in B.A. No. 966 of 2026, B.A. No. 964 of 2026 and B.A. No. 972 of 2026 respectively. The learned counsel also submits that another co-accused 2026:JHHC:9735 2 namely, Muchkund Das has also been enlarged on bail by a co-ordinate Bench of this Court vide order dated 10.03.2026 passed in B.A. No. 1348 of 2026. He submits that the present petitioner is similarly situated as that of the aforesaid co-accused. 7. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer and has submitted that the two victims have been identified and they have supported the case against the petitioner. 8. After hearing the learned counsel for the parties and considering the fact that the petitioner has been in custody since 18.11.2025 having no criminal antecedent and similarly situated co-accused persons have been enlarged on bail by co-ordinate Benches of this Court, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- II-cum-cyber-crime, Deoghar in connection with Deoghar (Cyber) P.S. Case No. 150 of 2025, on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned trial court. 9. The instant application is allowed with the aforesaid conditions. 10.
