C.R.M.(A) 1663 of 2026
In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Kaliganj P.S case no. 966 of 2025 dated 22/11/2025 under Sections 21(c)/29 of the NDPS Act. In the matter of: Sarman Sk @ Sarman Ali Sk ...Petitioner. Mr. Soumyajit Das Mahapatra Ms. Madhurai Sinha Ms. Upasana Banerjee Mr. Bisal Roy …for the petitioner. Mr. Somnath Bera …for the State.
Liberty is granted to the petitioner to amend the cause title. Learned advocate for the petitioner submits that the petitioner has been falsely implicated on the basis of the statement of co-accused, the same is controverted by the learned advocate for the State who submits that there are call detail records. The present case was registered on 22.11.2025 the call detail records reflect communication of about 15 telephonic calls between the petitioner and the accused in the month of September and October, 2025. Having considered the same and the fact that charge sheet has already been submitted before the jurisdictional Court and no recovery from the petitioner, further petitioner’s complicity is based on statement of co-accused, I am inclined to grant anticipatory bail to the petitioner.

Thus, prayer for anticipatory bail is allowed. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also abide by the conditions laid down under Section 438(2) of the Cr. P.C/482(2) of the BNSS. Since charge sheet has already been submitted, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, the application for anticipatory bail being CRM(A) 1663 of 2026 is allowed. Report filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
