ORDER 07-04-2026 Heard Mr. S. Islam, learned counsel for the applicant and Mr. K. K. Das, learned Additional Public Prosecutor, Assam.
2. This interlocutory application has been filed praying for time for their appearance before the Investigating Officer.
3. It is submitted that vide order dated 05.03.2026, passed in AB No. 439/2026, the petitioners were granted interim pre-arrest bail with a direction to appear before the I.O. within 7(seven) days from the date of order.
4. But the petitioner No.1 could not appear before the I.O. as he was arrested in connection with another case and the petitioner No.2 was also out of station and he was not informed by his family members.
5. However, both the petitioners are ready and willing to appear before the I.O.
Page No.# 3/3 and to cooperate in the further investigation of the case.
6. Mr. Das, learned APP raised no objection and submitted that a chance may be given to the petitioners to appear before the I.O.
7. In view of above, it is hereby directed that the petitioners shall appear before the concerned I.O. within a period of 7 (seven) days from the date of order and shall cooperate with the I.O. in the further investigation of the case.
8. With the above observation and direction, this interlocutory application stands
disposed of.
9. Registry shall list the connected AB No. 439/2026 on 30.04.2026 as fixed earlier and on the next date the concerned I.O. shall produce the updated case diary including the statements of the petitioners.
