Heard the learned counsel for the parties. 3. FIR in Crime No.1/2026 was registered by Basavanahalli Police Station, Chickmagalur for the aforesaid offences against petitioner and two others, based on the first information dated 11.01.2026 received from the injured victim Shahrukh alias Shoib Khan. Apprehending arrest in the case, petitioner had filed in Crl.Misc.Petition No.44/2026 which was rejected by the jurisdictional Sessions Court on 07.02.2026. Therefore, he is before this Court. - 3 - HC-KAR CNR: KAHC010331902026 NC: 2026:KHC:39001 CRL.P No. 6943 of 2026 4. Perusal of the material on record would go to show that first informant had borrowed money from the petitioner and had not repaid the same. It is in this background, petitioner and two other accused had confronted the first informant on 10.01.2026 inside a bar and restaurant and thereafter assaulted him with a sickle. The allegation of assaulting the first informant with a weapon on his right hand is found as the petitioner. The other accused persons allegedly had assaulted the first informant and his friend Suhel with hands. 5. Learned Addl. SPP on instructions has submitted that first informant and his friend Suhel have only suffered simple injuries in the incident in question. However, she has brought to the notice of this Court that petitioner is a person with criminal antecedents. 6. Under the circumstances, I am of the opinion that petitioner's prayer for grant of anticipatory bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: - 4 - HC-KAR CNR: KAHC010331902026 NC: 2026:KHC:39001 CRL.P No. 6943 of 2026 ORDER (i) The petition is allowed.
