p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.272 of 2026 Manas Ranjan Nayak … Petitioner Mr.S.C.Mohapatra, Sr.Advocate along with S.Mohapatra, Advocate -versus- State of Odisha … Opposite Party Mr. T.K.Acharya, Addl. PP CORAM:JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 24.03.2026 02. 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Kujang PS Case No.136 2025 corresponding to CT Case No.52 of 2025 pending in the file of learned Ad-hoc Addl. District & Sessions Judge (FTSC), POCSO, Jagatsinghpur for commission of offences punishable U/Ss. U/Ss.296/64(2)(m)/351(3) of BNS r/w Sections 67/67-A of IT Act, on the main allegation of committing rape upon the victim and getting her obscene photographs viral. 3. Heard, Mr.Soura Chandra Mohapatra, learned Senior Counsel who is being assisted by Mr.S.Mohapatra, learned counsel for the petitioner and Mr. T.K.Acharaya, learned Additional Public Prosecutor in the matter and perused the record including the deposition of the victim which was supplied. 4. Admittedly, the petitioner was granted liberty in BLAPL No. 5951 of 2025 to renew his prayer for bail after examination of the victim, but in the meantime the victim has already been examined in the trial and this Court, therefore, considers that there is little apprehension of tampering of evidence of material witness like victim. p. 2 Further, the petitioner is in custody since 06.04.2025 and in the meantime, near about one year is going to elapse just few days ahead. In the aforesaid fact and situation, especially when there is hardly any chance of tampering of evidence of material witness and taking into account the pre-trial detention of the petitioner in custody together with his inherent right to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merits admits the petitioner to bail. 5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following conditions:- (i) the petitioner in the course of trial shall attend the trial Court on each date of posting without fail unless his attendance is dispensed with. In case the Petitioner fails without sufficient cause to appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioner for offence U/S.269 of BNS, 2023 in accordance with law. 6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G. Satapathy) Judge kishore
