31.07.2026 Court No.35. D/L.45. Rakib (Allowed) CRM (A) 1642 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Nabadwip Police Station case no. 230 of 2026 dated 29.05.2026 under Sections 303(2)/314/316(2)/316(5)/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Manoj Kumar Roy & Ors. ……Petitioners. Mr. Sayan Mukherjee Mr. Amenul Islam Mr. Sourav Mukherjee Mr. Gourav Roy .....for the Petitioners. Mr. Imran Siddiqui ……for the State. Learned advocate appearing for the petitioners submit that petitioners are innocent and have been implicated in connection with the present case because of earlier rivalries. Learned advocate appearing for the State submits that there are relief materials which were seized from the club. The initial seizure took place on 29.05.2026 and the Case Diary do not reflect any further seizure having taken place. The conduct of the accused persons are not acceptable, however, since there has been no subsequent seizures in the present case, I am of the opinion that custodial interrogation for the sake of investigation may not be warranted. As such, the prayer for anticipatory bail of the petitioners namely, Manoj Kumar Roy, 2 Ganesh Kansabanik, Paresh Chandra Saha, Balai Chandra Goswami, Gosto Bhattacharya and Satyajit Saha is allowed. Accordingly, I direct that in the event of arrest, the petitioners shall furnish bonds subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As, the investigation of the case is still in progress, petitioners shall meet with investigating officer of the case within a period of 10 days from date, thereafter the investigating officer will fix necessary and specific dates for further appearance of the accused persons for the sake of investigation. With the aforesaid observations, CRM (A) 1642 of 2026 is allowed. Pending application (s), if any, is consequently disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
