p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.341 of 2026 Panu @ Pranabandhu Sahu … Petitioner Mr. S.K. Pattnaik, Advocate -versus- State of Odisha … Opposite Party Mr. T.K. Acharya, Addl. PP JUSTICE G. SATAPATHY Order No. ORDER(ORAL):24.03.2026 01. 1. This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Bantala PS Case No.129 of 2022 corresponding to CT(S) Case No.53 of 2023 pending in the Court of learned Addl. Sessions Judge(LR & LIV), Angul for commission of offence punishable U/S. 302 of IPC, on the main allegation of committing murder of the deceased Ami Dehury by entering into conspiracy with co-accused persons. 2. Heard, Mr. Susil Kumar Pattnaik, learned counsel for the petitioner and Mr. T.K. Acharya, learned Addl. PP in the matter and perused the record. 3. Admittedly, the Petitioner was granted liberty in BLAPL No. 6707 of 2024 to renew his prayer for bail after examination of witnesses Kuna Dehury, Dali Amanta and Kalia @ Bibekananda Sahu who have already been examined in the meantime, but none of them have stated about the presence of the Petitioner at the spot of assault to the deceased. Besides, the Petitioner is in custody since 24.08.2022 and in the meantime, 3 and ½ years have elapsed, but the trial is yet to be concluded. It is no doubt true that there is of course allegation against the p. 2 Petitioner for entering into conspiracy, but trial is yet to be concluded even after 3 and ½ years of the custody of the Petitioner. Additionally, co-accused Priyadashan Sahu, who is the younger brother of the present Petitioner has already been granted bail. In the aforesaid facts and circumstance and taking into account the detention of the Petitioner for 3 and ½ years without trial being concluded, this Court without expressing any view on merits admits the Petitioner to bail, but subject to certain condition. 4. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) only with two solvent sureties for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:- (i) The petitioner shall cooperate in the trial by attending the Court on each date of posting unless his attendance is dispensed with by the learned trial Court and In case the petitioner fails without sufficient cause to appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioner for offence U/S.269 of BNS, 2023 in accordance with law. 5. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e- mail for reference. (G. Satapathy) Judge Priyajit
