The petitioner is in custody for more than 400 and prays for bail. Learned counsel for the petitioner submits that despite an earlier direction, the trial has not proceeded much. Opposing the prayer, learned counsel for the State submits that the trial has been delayed mostly at the instance of the petitioner who took adjournments before the learned trial Court. In turning down the bail prayer of the petitioner by an order passed on 13th June, 2022, this Court granted liberty to the petitioner to renew his prayer for bail after the evidence of CSW 1,2 and 3 was complete. This Court is informed that the said witnesses are yet to be examined. Considering the fact that contraband article of commercial quantity has been recovered from the petitioner, the petitioner is
2 unable to rebut the statutory restriction under Section 37 of the NDPS Act. Accordingly, prayer for bail is rejected at this stage. Learned trial Court is directed to examine CSW 1,2 and 3 as expeditiously as the business of the Court would permit. CRM (NDPS) 581 of 2025 is accordingly disposed of. Urgent certified website copy of this order, if applied for, be given to the parties, upon compliance with all requisite formalities.
