NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 6831 of 2026 Bhima Korram Nag S/o Nakul Aged About 45 Years Caste Muriya, R/o Kavadgaon Bade Para Bhanpuri Distt. Bastar, Chhattisgarh
... Applicant versus State of Chhattisgarh Through P.S. Bhanpuri, Distt. Bastar, Chhattisgarh
... Non-Applicant For Applicant : Mr. Vikash A. Shrivastava, Advocate. For Non-Applicant/State : Ms. Ritika Verma, Panel Lawyer. Hon’ble Shri Ramesh Sinha, Chief Justice Order on Board 07.08.2026
1. The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.43/2026 registered at Police Station – Bhanpuri, District - Bastar, (C.G.) for the offence punishable under Section 109(1) of Bharatiya Nyaya Sanhita, 2023. 2. As per the rejection order, the prosecution case is that the complainant, Khageshwar Baghel, lodged a written report alleging that on the night of 11.04.2026, after having dinner, his mother-in-law, Kamli, and father-in- law, Bhursu Korram, were sitting in the courtyard. At about 8:00 p.m., his father-in-law went to his house. Shortly thereafter, upon hearing cries emanating from his father-in-law's house, the complainant, along with his PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.08.10 11:14:29 +0530
2 wife, rushed to the spot, where he allegedly saw the present applicant/accused, Bhima Korram, standing at some distance holding an iron rod after having assaulted his father-in-law with the said iron rod. On being asked about the incident, the injured, Bhursu Korram, informed the complainant that the applicant had assaulted him over a land dispute, causing injuries to his neck and cheek, resulting in bleeding. The incident was reported to Police Station Bhanpuri, whereupon the injured was taken to the Civil Hospital and was subsequently referred to Dimrapal Medical College for further treatment, where he was undergoing treatment. On the basis of the said written complaint, the present FIR was registered against the applicant. 3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submitted that the injury suffered by the victim is simple in nature.
Further the applicant has no previous criminal antecedents, the charge-sheet has been filed in this case and the applicant is in jail since 15.04.2026 and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail. 4. On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has already been filed. She further contends that the applicant allegedly assaulted the injured with a sickle, causing grievous injuries. It is submitted that the injured sustained injuries to the cervical spine and, as per the NCCT reports, suffered a fracture of the C6 vertebra. It is further submitted that the injured had to undergo surgery. Therefore, it is contended that, considering the nature and gravity of the injuries, the applicant is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the documents
3 available on record. 6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicant, and the fact that the applicant is alleged to have assaulted the injured with a sickle, causing grievous injuries, the injured sustained injuries to the cervical spine and, as per the NCCT report, suffered a fracture of the C6 vertebra, it is further noted that the injured had to undergo surgery, considering the seriousness of the injuries and the overall facts and circumstances of the case, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant - Bhima Korram Nag involved in Crime No.43/2026 registered at Police Station – Bhanpuri, District - Bastar, (C.G.) for the offence punishable under Section 109(1) of Bharatiya Nyaya Sanhita, 2023, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
