And In Re : Md. Jamal ... Petitioner. Mr. Ayan Basu Mr. Sk. Salim Mr. Sumit Routh ... For the Petitioner. Mr. S. Gupta ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for three years one month and so far the evidence which has surfaced till date prosecution relies upon 23 witnesses to prove its case. There is a loose trail of complicity against the petitioner for which he can be implicated in the offence in respect of the trial in progress. The further conclusion of the trial will consume a substantial amount of time. As such the petitioner be released on bail on any stringent conditions. 2 Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that offending weapon was recovered on the leading statement of the present petitioner. He further submits that petitioner has number of criminal antecedents (seven). Having considered the overall circumstances of the present case, an opportunity is granted to the prosecution to expedite the process of trial. The petitioner would approach this Court with better particulars so far as the materials against the present petitioner is concerned after the charges are framed against him and so far as the other cases which the prosecution has referred to. At this stage, the application for bail, being CRM (M) 1635 of 2026, is dismissed. Memo of evidence be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
