Sinha, Advocate ---- 05/07.04.2026 This writ petition has been filed under Article 226 of the Constitution of India wherein the prayer has been made for quashing of the order dated 21.05.2012 passed by the respondent 2026:JHHC:10156 -4- no.2 in P.W. Case No.1 to 31 of 2009 whereby the direction has been issued to the petitioner to forthwith make payment of a sum of Rs.1,01,188.40 in favour of the respondent nos.4 to 34. 2. By the impugned order, the Deputy Labour Commissioner Cum Authorized Officer under the Payment of Wages Act, has issued the direction to pay the wages as per the enclosure of the said order to the different workmen. 3. It appears that this petitioner has filed this petition in personal capacity wherein the direction has been issued upon the post and in view of that, the petitioner is not liable personally and the person who is holding the office of the Executive Engineer only is liable for the same and further that the amount is very meagre and it appears that the poor workmen have not been paid to the tune of Rs.3,834/- and odd and the same is the position about the 34 persons as per the enclosure of the order, and as such, this petition is disposed of, clarifying the above position, and the office of the Minor Irrigation Department, Bokaro, is liable for payment. 4.
