This interlocutory proceeding has arisen out of an application under Page No.# 3/4 Section 5 of the Limitation Act, 1963 seeking condonation of delay of 511 days in filing a criminal revision against the order dated 03.02.2024 passed by the learned Special Judge, Morigaon. By the said impugned order, the learned Special Judge was pleased to amalgamate Jagiroad PS case no. 451/2021 and Jagiroad PS case no. 453/2021, corresponding to Special Sessions case nos. 13/2022 and Special Sessions case no. 14/2022 respectively. Pursuant to such amalgamation, the learned Trial Court was pleased to frame charges under section 120(B)/489(A)/ 489(B)/489(C)/489(D) IPC. The grounds for the delay have been narrated at paragraph 4 of the application. It is stated that the delay occurred due to lack of persons in the family of the petitioners who could come to Guwahati to meet the counsel and prepare the case. It is also submitted that the revision had to be prepared to challenge the amalgamation as well as the framing of charges. They submitted that the petitioners are residents of West Jaintia Hills district in the State of Meghalaya. The prosecution fairly submits that it has no objection to the delay condonation. Considering the grounds of delay condonation adduced; that the petitioner is aggrieved by framing of charges and no objection of the prosecution, I deem it proper to condone the delay. Accordingly, the delay of 511 days in preferring the revision petition, is hereby condoned. IA stands disposed of. Page No.# 4/4 The revision may be registered and put up for admission.
