JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused in SC No.1126/2017 pending before the Court of XXVIII Addl. City Civil and Sessions Judge, Bengaluru, arising out of Crime No.103/2017 registered by Viveknagar Police Station, Bengaluru, for the offence punishable under Section 307 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. Petitioner, who was earlier arrested in the present case was granted regular bail by the Trial Court in SC No.1126/2017 by order dated 24.10.2017. It appears, for the reason that petitioner had not appeared before the Trial Court subsequently on the regular dates of hearing, coercive steps were taken against him and he was arrested and produced before the Trial Court on 01.05.2026 and on the said day, he was remanded to judicial custody. His bail application filed before the Trial Court subsequently was rejected. Therefore, he is before this Court. - 3 - HC-KAR CNR: KAHC010420032026 NC: 2026:KHC:39423 CRL.P No. 8904 of 2026 4. It is not in dispute that petitioner has no other criminal antecedents. On the merits of the case, he was granted regular bail in the present case by the jurisdictional Sessions Court. After the case was committed, only for the reason that petitioner had not appeared before the Trial Court on the regular dates of hearing, coercive steps were taken against him and his presence was secured on 01.05.2026 and on the said day, he was remanded to judicial custody. For the mistake committed by the petitioner, who was earlier granted regular bail in the present case, is now sufficiently punished. He has undertaken to co-operate with the Trial Court for speedy disposal of the case and also abide by the conditions that may be imposed on him. Under the circumstances, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.1126/2017 pending before the Court of XXVIII Addl. City Civil and Sessions Judge, Bengaluru, arising out of Crime No.103/2017 registered by Viveknagar Police Station, Bengaluru, for the offence punishable under Section 307 of IPC, subject to the following conditions: - 4 - HC-KAR CNR: KAHC010420032026 NC: 2026:KHC:39423 CRL.P No. 8904 of 2026 a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
