1. The matter was taken up out of turn on mention made by the learned counsel for the petitioners.
2. It is submitted by the learned counsel for the petitioners that the grievance of the petitioners shall stand redressed by directing the respondents to consider their case for extension/transfer of the lease hold rights in respect of the subject matter of the petition i.e., land measuring 6 Kanal and 17 Marlas under Khasra No. 2657 and 2658 situated at revenue estate Ushkura, Baramulla in their favour, that was already leased out in favour of their predecessor-in-interest namely Gh. Hassan Sheikh vide
order 58/2015 dated 09.04.2018. It is further submitted by the learned counsel that the petitioners being the legal heirs of the deceased allottee have always been ready to pay the outstanding premium as fixed in the earlier allotment order dated 09.04.2018.
3. It is further submitted that impugned notice dated 25.02.2022 in the name of the deceased served upon the petitioners is illegal.
4. The Court has gone through the contents of the petition and the documents enclosed with the same. In the facts and circumstances of the case the Court is of the opinion that it may be the ends of the justice in case as prayed, by the learned counsel for the petitioners, the respondents are directed to consider the case of the petitioners as projected in the writ petition and pass the appropriate orders under law within a period of two months.
5. Accordingly Ordered.
6. Petition is stands disposed of.
