……Petitioner. Mr. Dipanjan Chatterjee
Ms. Dipika Banu
Mr. Subhadip Chakraborty
……for the Petitioners. 2 Ms. Afreen Begum Mr. Meghjit Ghosh Ms. Bhawna Das
……for the Defacto Complainant. Mr. L. Vishal Kumar
……for the State in item no. 11. Ms. Priti Kar Bagchi
…..for the State in item nos. 12 & 13. Learned advocate appearing for the petitioners submits that so far as the accusations made in the application under Section 175(3) of the BNSS is concerned, the same was pursuant to an agreement entered and the same was for supply of goods. Learned advocate for the defacto complainant opposes the prayer for anticipatory bail and submits that the accused petitioners were inviting different transporters to provide logistic supports and after obtaining their services they either changed their addresses and were unable for disbursements. Learned advocate for the State opposes the prayer for bail. I have taken into account the background of the case as well as the accusations in the application under Section 175(3) of the BNSS wherefrom prima facie it reflects that there was non-payment of freight charges of 27 Lakhs by the company of the petitioners.
Having regard to the overall circumstances, I am of the view although the investigation should continue, but a case for custodial detention has not been made out. 3
Accordingly, prayer for anticipatory bail of the petitioners is allowed. As such, I direct that in the event of arrest, the petitioners namely, (1) Sreerupa Bhowmick, (2) Amitabha Bhowmick, (3) Priyanka Dey @ Priyanka Bhowmick be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation is in progress the petitioner in CRM (A) 1503 of 2026 namely, Amitabha Bhowmick will make himself available before the Investigating Officer within a period of 10 days and on all subsequent dates when the Investigating Officer deems fit and proper. So far as the other petitioners are concerned they would cooperate with the investigation of the case. With the aforesaid observations, CRM (A) 1502 of 2026, CRM (A) 1503 of 2026 and CRM (A) 1504 of 2026 are allowed. Pending application(s), if any, is consequently disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 4 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
