Learned advocate also submits that other accused person has been granted anticipatory bail. Learned advocate for the State opposes the prayer for bail and submits that the present petitioner is an influential person, as such, the defacto-complainant could not gather courage to inform the police authorities. 2 I have taken into account the nature of the complaint. The incident complained of is almost four years ago. Consequently, I direct that the investigation may continue but custodial detention of the present petitioner may not be warranted in the facts of the present case. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Chanchal Kumar Khanra] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner shall meet with the Investigating Officer of the case within a period of 10 days, thereafter, the Investigating Officer will fix necessary dates for the petitioner to attend the police station for the sake of investigation. Accordingly, CRM (A) 1643 of 2026 is disposed of. Pending application(s), if any, is also disposed of. 3 Memo of evidence and the report submitted by the State be kept with the record.
