THIS CCC IS FILED UNDER SECTION 11 AND 12 OF THE CONTEMPT OF COURT ACT, READ WITH ARTICLE 215 OF THE CONSTITUTION OF INDIA PRAYING TO INITIATE ACTION AGAINST THE ACCUSED CONTEMPT OF THIS HON'BLE COURT FOR NON- IMPLEMENTATION THE ORDERS OF THIS HON'BLE COURT IN W.P.NO.38163/2025 (KLR-RES) DATED 12.01.2026 VIDE ANNEXURE- A & ETC.
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MRS. JUSTICE K.S. HEMALEKHA
ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)
1. The complainant has filed the present petition alleging willful disobedience of the order dated 12.01.2026 passed by the learned Single Judge of this court in W.P.No.38163/2025 (KLR-RES), whereby the learned Single Judge had directed that name of the complainant be entered in the revenue records on the basis of the registered sale deed dated 17.10.2025. The court had also granted liberty to the accused-Tahsildar to initiate proceedings before the Assistant Commissioner, if the Tahsildar was of the opinion that the same was contrary to the provisions of Section 4(2) of the Karnataka Scheduled Castes and Schedules Tribes (Prohibition of Transfer of Certain Lands) Act, 1978 [PTCL Act].

CNR: KAHC010252742026 NC: 2026:KHC:39914-DB CCC No. 428 of 2026
2. The accused did not enter the name of the complainant in the revenue records but initiated proceedings before the Assistant Commissioner under Section 4 of the PTCL Act. The said proceedings culminated in the order dated 14.07.2026, whereby the sale deed has been declared as null and void under Section 4(1) of the PTCL Act.
3. In view of the above, we do not consider it apposite to initiate any proceedings for not entering the complainant's name in the revenue records.
4. The complaint is accordingly closed. We, however, clarify that this order would not preclude the complainant for availing substantive remedies in respect to his grievance including the order passed by the Assistant Commissioner.
