Learned senior advocate appearing for the petitioners submit that there is old standing property dispute existing between the present petitioners as well as the family of the de-facto complainant. There are case and counter cases in respect of the same incident where injuries sustained by different set of accused persons in respect of each of the groups. So far as the family of the present petitioners are concerned, some of them sustained injuries for which stitches had to be administered and the FIR which has been registered at the behest of the present accused persons resulted in anticipatory bail being granted to all the accused persons by the learned Sessions Judge. Learned advocate appearing for the State produces the Case Diary and opposes the prayer for anticipatory bail. Attention of the
2 Court has been drawn to the injury report as well as the statement of the injured being one Rajmati Devi. Having considered the statement of the injured as well as the injury report, I am of the opinion that so far as the prayer for anticipatory bail of the petitioner nos. 2 and 3 are concerned, the same cannot be approved. As such, prayer for anticipatory bail of the petitioner nos. 2 and 3 namely, Gobind Yadav and Sobin Yadav @ Shobind Yadav are rejected. So far as the prayer for anticipatory bail of the petitioner nos. 1, 4 and 5 are concerned, their custodial detention may not be warranted in the facts of the present case. As such, the prayer for anticipatory bail of the petitioner nos. 1, 4 and 5 being Sita Devi Yadav, Chandan Yadav and Subhash Yadav is allowed. Accordingly, I direct that in the event of arrest, the petitioner nos.
1, 4 and 5 shall furnish bonds subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As, the investigation of the case is still in progress, petitioner nos. 4 and 5 shall meet with investigating officer of the case within a period of 10 days from date and thereafter on subsequent dates as fixed by the investigating officer of the case. With the aforesaid observations, CRM (A) 2426 of 2026 is partly allowed. 3 Pending application (s), if any, is consequently disposed of. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
