On interrogation, the petitioner disclosed that he had brought the intoxicating substances from Delhi and used to supply the same further. On his disclosure, two persons were nominated as co- accused, one of whom had been arrested. Investigation now stands concluded. 3. It is argued by learned counsel for the petitioner that he has been falsely implicated in this case. A false recovery has been planted upon him. Further incarceration of the petitioner would not serve any useful purpose. More so, he is a patient of renal colic and is suffering from severe pain. He needs specialized treatment which he is not getting while being in jail. It is, therefore, urged that the petition deserves to be allowed. 4. Per contra, learned State counsel has argued that keeping in view the gravity of the allegations as levelled against the petitioner, he does not deserve to be extended benefit of bail. He has also argued that the petitioner has undergone surgery at GGS Medical College, Faridkot and was discharged on 20.03.2026 in satisfactory condition. It is, MANJU 2026.07.21 13:35 I attest to the accuracy and authenticity of this order /judgment Chandigarh CRM-M No.20218 of 2026 -3- therefore, argued that he does not deserve to be extended benefit of bail. 5. This Court has considered the rival submissions. 6. The petitioner is alleged to have been found in possession of commercial quantity of contraband/intoxicating substances. The rigors of Section 37 of NDPS Act are attracted in this case. The allegations against him are serious in nature. He is shown to have undergone a surgery. He has placed on record medical card which shows that the treating doctor has advised him to plan for removal of stent. However, there is nothing on record to suggest that he has not been provided proper treatment while being in jail. As such, on medical ground, no concession of bail deserves to be extended to the petitioner. Taking into consideration the gravity of the allegations as levelled against the petitioner, the quantum of sentence which the conviction may entail and the attendant facts and circumstances, this Court is of the considered opinion that there is no compelling ground to extend benefit of bail to the petitioner. Accordingly, the petition is dismissed. 7. It is, however, clarified that observations made hereinabove shall not be construed as an expression of opinion on the merits of the case.
