This writ petition alleges arbitrary action on the part of the respondent WBSEDCL authorities in keeping the petitioner’s representation dated July 24, 2024 pending. 2. Learned advocate appearing for the petitioner submits that the private respondent has been granted electricity supply thereby granting electricity supply to the private respondent for operating his submersible pump within a distance of two hundred meters from the petitioner’s existing submersible pump without following the regulatory norms. 3. Mr. Mukherjee, learned advocate appearing for the WBSEDCL authorities submits that all norms have been followed and the private respondent’s submersible pump wherefor electricity supply has 2 been granted, does not fall in either critical or semi critical zone. It is submitted that the private respondent’s submersible pump is under the ‘green zone’. 4. Mr. Halder, learned advocate appearing for the private respondents submits that his client has made application complying with all the requisite formalities and following all the norms and regulations and it is only after ensuring that all compliances have been made that the WBSEDCL authorities have granted connection. 5. Without expressing any opinion on the submissions made by the respective parties, this Court is of the view that since a representation has been made before the WBSEDCL authorities, the WBSEDCL authorities should dispose of the same by intimating the petitioner as to why should the petitioner’s request for not granting electricity supply to the private respondent for operation of his submersible pump, not been considered. 6. Accordingly, the Station Manager, Sagardighi Customer Care Centre (respondent no. 2) is requested to consider and dispose of the petitioner’s representation dated July 27, 2024 (Annexure ‘P5’ at page 22 of the writ petition) in accordance with law. 7. Mr. Halder further submits that submersible pump of the petitioner has not yet been energised and 3 only the petitioner’s application seeking grant of electricity supply to the submersible pump has thus for been sanctioned by the WBSEDCL authorities. It is submitted that the submersible pump could not been energised due to objection raised at the site. 8. In such view of the matter, while the WBSEDCL authorities, shall dispose of the representation given by the petitioner within a week from date, they shall also alongside, take appropriate steps for grant of electricity supply in favour of the petitioner in accordance with law. 9. With the above observations, WPA 17727 of 2026 stands disposed of. There shall be no order as to costs. 10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
