Kausik (Allowed) CRM (A) 1511 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kolaghat Police Station Case No. 305 of 2026 dated 19.05.2026 under Sections 126(2)/308(2)/308(5)/351(3)/3(5) of the BNS, 2023. And In the matter of : Sk. Ushub Ali @ Sk. Isub Ali ……Petitioner. Mr. Sandipan Ganguly, Sr. Adv. Mr. Sabir Ahmed Mr. Bhaskar Hutait ……for the Petitioner. Mr. Vishal Kumar ……for the State. Leave is granted to the advocate on record of the petitioner for amending the cause title. Learned senior advocate appearing for the petitioner submits that the subject matter of the FIR itself reflect that accusations which were continuing for considerable period of time and the petitioner being affiliated to a political party has been implicated in the present criminal case after there was change in administration. Learned advocate for the State opposes the prayer for anticipatory bail and submits a report. 2 Having regard to the nature of accusations, I am of the opinion, custodial detention may not be warranted in the facts of the present case. As such, prayer for anticipatory bail of the petitioner is allowed. As such, I direct that in the event of arrest, the petitioner namely, Sk. Ushub Ali @ Sk. Isub Ali be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress petitioner shall within a period of 10 days meet with the Investigating Officer of the case and thereafter subsequently make himself available as and when called for by the Investigating Officer of the case. With the aforesaid observations, CRM (A) 1511 of 2026 is allowed. Pending application(s), if any, is consequently disposed of. Report submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
