Order on Board (21st August, 2026) The instant MCC has been filed for restoration of WPC No.5309/2022 which was dismissed by virtue of peremptory order dated 5.12.2022.

Learned counsel for the applicant submits that WPC No.5309/2022, parties being Smt. Pushpa Ramteke Vs. State of CG and others, was dismissed on 7.1.2023 in compliance of the peremptory order dated 5.12.2022 as the applicant/petitioner could not remove the default within the stipulated period. He submits that as the documents which were to be filed by the applicant/petitioner were not available with him, the default could not be rectified as directed. However, he submits that the applicant/petitioner wants to contest the writ petition on merits, therefore, the present MCC may be allowed and the writ petition be restored to its original number.

Learned counsel for the State/respondents No. 1 & 4 has no objection to the aforesaid prayer of the applicant.

05. Upon due consideration of the reasons mentioned in the MCC which is duly supported by affidavit of the applicant/petitioner, the same
3 is allowed and the orders dated 5.12.2022 and 7.1.2023 are hereby recalled.
