Having regard to the nature of the controversy and the fact that the petitioner has an efficacious remedy to raise all permissible grounds and defences before the learned trial Court, this Court is of the view that no interference is called for at this stage. 3. Accordingly, the instant petition is disposed of, granting liberty to the petitioner to raise all such permissible grounds and defence as may be available to him under law before the trial Court. The trial Court shall consider and decide the same in accordance with law, after affording due and proper opportunity of hearing to the parties. 4. It is made clear that disposal of the present petition shall not preclude the trial Court from proceeding with the matter in accordance with law and as per the schedule fixed before it.
