2. This writ petition has been filed by Jal Sansthan Samvida Shramik Sangh on behalf of its 34 members. List of members is enclosed as Annexure-1 to the writ petition.
3. According to the petitioner, its members were engaged through outsourcing in Uttarakhand Jal Sansthan on different dates between 1999 to 2013; their work and conduct was found to be satisfactory and there was no complaint or adverse material against them; however, their engagement was arbitrarily discontinued in the month of May, 2025.
4. It is contended that discontinuance of petitioners is contrary to Government Policy, as contained in Government
Order dated
11.08.2023. Para 4 of said Government Order is relied upon by petitioner, which provides that posts against which persons engaged through outsourcing are serving shall not be treated as vacant.

5. Mr. Pankaj Chaturvedi, learned counsel appearing for Uttarakhand Jal Sansthan, however, submits that petitioners were engaged through contractor and the contractor concerned has engaged another set of persons on
15.06.2025. He, however, submits that if petitioners make representation for their re- engagement to the Chief General Manager in the concerned Division of Jal Sansthan, then their request shall be considered favourably.
6. Accordingly, the writ petition is disposed of by permitting petitioners to make separate representation to the competent authority (Chief General Manager). If they make such representation within three weeks from today, decision thereupon shall be taken as per law, within three months thereafter.
