The petitioner has filed the instant petition under Articles 226/227 of the Constitution of India, seeking issuance of a writ of certiorari for quashing the order dated 01.09.2020 (Annexure P-3), passed by respondent No.4, vide which, while reinstating the petitioner in service w.e.f. 04.03.2009, the period from 08.10.1999 to 14.12.1999 (68 days), suspension period from 15.12.1999 to 03.04.2002 (841 days) and period from 04.03.2009 to 01.09.2010 i.e. period considered for dismissal to reinstatement, has been considered as ‘No Work No Pay’ and ordered to not to be considered to the financial benefits including seniority, promotion, salary, increments and arrears etc. Further, seeking issuance of a writ of mandamus directing the respondents to count the aforesaid period as duty period for all intents and purposes; to regularize the suspension period from 08.10.1999 to 03.04.2002 and consider the period as a duty period and to pay the remaining 50% salary along with interest; and to pay remaining 25% salary, increments accrued to VINOD KOTHIYAL 2026.07.21 09:55 I attest to the accuracy and authenticity of this document CWP-17410-2026 -2- petitioner for the period commencing from 04.04.2002 to 04.03.2009 and to pay the same along with interest @ 12% per annum. 2.
