The Court: Affidavit of service is taken on record. Despite service, none appears on behalf of the respondent. The petitioner has preferred the present petition under Section 29A of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the arbitral tribunal for conclusion of the arbitral proceedings and publication of the arbitral award. This Court vide order dated 27.09.2021 had appointed a learned sole arbitrator to adjudicate the disputes between the parties. Pleadings were completed on 03.03.2022. Since the mandate of the learned arbitral tribunal was not extended by the consent of the parties, the petitioner approached this Court seeking extension of the mandate of the arbitral tribunal. This Court vide order dated 30.08.2023 dismissed the said petition. Aggrieved thereby, the petitioner approached the Hon’ble Supreme Court by filing a Special Leave Petition. The Hon'ble Supreme Court vide
order dated 23.10.2024 partly allowed the said Special Leave Petition and

remitted the matter to this Court for appointment of a new sole arbitrator to adjudicate the disputes between the parties. This Court vide order dated 07.01.2025 substituted the earlier learned arbitrator with a newly appointed learned arbitrator to adjudicate the disputes between the parties. The respondent failed to appear before the newly appointed learned arbitrator and the matter has proceeded ex-parte. Learned counsel for the petitioner states that the matter is presently at the stage of arguments. Upon consideration of the submission of the petitioner and the materials placed on record, this Court is satisfied that there has been no undue or unwarranted delay on the part of the learned tribunal in conducting the arbitral proceedings. Having regard to the advanced stage of the proceedings and in the interest of justice, the mandate of the learned arbitral tribunal is extended for a further period of six months from today. The learned arbitral tribunal is requested to make all reasonable endeavours to conclude the arbitral proceedings and publish the arbitral award within the extended time period. With the aforesaid directions, the present petition stands disposed of.
