THIS WRIT PETITION IS LISTED FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, AN ORDER IS MADE AS UNDER:
ORAL ORDER Sri.Abhijeet S.K. Rai, counsel for the petitioner, and Smt.Nandita Haldipur, counsel for the respondent, appeared in person. 2. This petition is filed seeking the following reliefs: (a) Issue a writ of certiorari to set aside the order dated 02.07.2026 passed on I.A.No.2 by the Hon'ble Central Government Industrial Tribunal, at Bangalore in EPF/ITB/No.383/2017 vide Annexure-A. (b) Consequently allow the I.A.No.2 i.e., an application under Rule 21 of EPF Appellate Tribunal Rules, 1997 r/w Section 151 of CPC r/w 7-L r/w7-O of the EPF & MP Act, 1952 seeking modification of the order dated 08.05.2026 "thereby permitting the appellant to deposit the 20 & of the assessed amount

before the "Registrar of CGIT" payable at Delhi" instead of depositing with the respondent and the same to be kept in FDR (Fixed Deposits) till disposal of the case vide Annexure-E to the writ petition. (c) To grant such other relief as this Hon'ble Court deems fit in the facts and circumstances of the case, including award of the cost of these proceedings, in the interest of justice and equity. 3. Counsel for the petitioner contended that, no employees were identified and they were not enrolled.
He further submitted that the order directing deposit of 20% of the assessed amount of ₹37,67,521/- as a pre-deposit with the respondent would not accrue interest, whereas deposit with the Registrar, CGIT, payable at Delhi, would earn interest. Reliance was placed on Annexures G, G1, and G2, wherein similar directions were issued permitting deposit by demand draft in favour of the Registrar, CGIT, Delhi. - 4 -

Counsel for the respondent opposed the petition. 4. Heard the parties and perused the records. 5. In the present writ petition, the Presiding Officer directed the petitioner to deposit 20% of the assessed amount of ₹37,67,521/- as a pre-deposit with the respondent. As such a deposit would not accrue interest, no prejudice would be caused to the respondent if the petitioner is permitted to deposit the said amount by a demand draft in favor of the Registrar, CGIT, Delhi. 6. For the reasons stated, the petition is disposed of. The petitioner is permitted to deposit 20% of the assessed amount of ₹37,67,521/- as a pre-deposit by demand draft in favor of the Registrar, CGIT, payable at Delhi, within one week from receipt of a certified copy of this order. - 5 -
