Learned counsel for the petitioner submits that the petitioner was posted as a Constable (Driver) in the Transport Department of the 1st Battalion, Chhattisgarh Armed Force (CAF). It is submitted that the petitioner was charged with violating the provisions of the Police Regulations on the allegation that he remained absent from the nightly roll call without informing the competent authority and had willfully disobeyed official orders. Upon conclusion of the departmental enquiry, the disciplinary authority passed the final order imposing the major penalty of removal from service. Learned counsel further submits that, aggrieved by the said order of punishment, the petitioner preferred a statutory departmental appeal, annexed as Annexure P-1. It is further submitted that despite the lapse of a considerable period, the said appeal has not been decided and remains pending till date. 3. Per Contra, learned counsel for the respondents would submit that if the appeal preferred by the petitioner is still pending consideration, the same will be decided within a period of 45 days in accordance with law. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Considering the submissions advanced by learned counsel for the parties and without expressing any opinion on the merits of the case, the present writ petition is disposed of with a direction to 3 respondent No.2 to consider and decide the petitioner's departmental appeal, in accordance with law on its own merits, within a period of 45 days from the date of receipt of copy of this order.
