Respondent(s) For Petitioner(s) : Mr. Govind Dewangan, Advocate For Respondent(s) : Mr. Pankaj Agrawal, Advocate Hon’ble Shri Sanjay K. Agrawal, Judge Order on Board 05.08.2026 1. The present writ petition has been filed challenging the action of the respondents, particularly respondent No. 4, in granting monetary compensation to the petitioner only prospectively with effect from 01.04.2018 vide order dated 16.08.2019 (Annexure P/1), instead of granting the same from 27.11.2003, the date on which the petitioner first applied for compassionate appointment. Digitally signed by JYOTI JHA Date: 2026.08.06 11:31:06 +0530 2 2. Learned counsel for the petitioner submits that despite the petitioner having applied for compassionate appointment on 27.11.2003, the respondents neither considered nor decided her claim within a reasonable time. It is submitted that the delay is wholly attributable to the respondents, yet monetary compensation has been granted only with effect from 01.04.2018. Therefore, the petitioner is entitled to monetary compensation from the date of her original application, i.e., 27.11.2003. 3. Learned counsel for respondent submits that if the petitioner files a fresh representation before the competent authority, the same shall be considered and decided in accordance with law. 4. Be that as it may, the petitioner is directed to submit a fresh representation before the competent authority claiming monetary compensation with effect from 27.11.2003. Upon receipt of such representation, the concerned authority shall consider and decide the same, in accordance with law, by passing a reasoned and speaking order within a period of six weeks thereafter. 5. It is made clear that this Court has not expressed anything on the merits of the case. 6. Accordingly, the present writ petition stands disposed of. Sd/- (Sanjay K. Agrawal) Judge Jyoti
