Present petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of FIR No.132 dated 09.12.2025, registered at Police Station Arif Ke, District Ferozepur, Punjab, under Sections 125/351(2)/3(5) of BNS and 25 of Arms Act, 1959.

In regard to the incident happened at 7:45 p.m. on 09.12.2025 complainant-Rajwinder Kaur, got registered the FIR with the allegation that some one called from outside the main gate that come out they want to kill complainant's son Lovepreet Singh. CRM-M-38058-2026 2 Then, petitioner fired a shot in the air with his pistol and threatened complainant that he will not spare his son Lovepreet Singh. On raising noise by her neighbours get started gathering there and then all accused fled away from the spot. In this process, four live cartridges from the pistol of petitioner fell on the ground however, other accused namely Rohindeep Singh and Jobanpreet Singh succeeded in running away alongwith their weapons.
3.
Learned counsel for the petitioner argues that the role assigned to the petitioner is of firing bullet in the air and while running, four live cartridges fell down on the ground. Petitioner is inside jail for the last more than a period of 07 months and is rather the complainant party in the other case, which stands registered against the husband and son of the complainant in the impugned FIR. Thus, prays for grant of concession of regular bail.
4. On the other hand, the learned State counsel submits that considering the allegation against the petitioner, he does not deserve any concessional relief and if released from jail, he will definitely get involved in some other similar offence.
5. I have heard learned counsel for the parties and perused the relevant material available on record with their able assistance.
6. Accordingly, without commenting upon the merits of the case, and keeping in view the overall facts and circumstances, nature of allegations, period of incarceration already undergone, and the stage of trial, this Court deems it a fit case for grant of regular bail to the petitioner. Consequently, prayer made in the present petition is allowed. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety REENA 2026.07.21 15:23 I attest to the accuracy and integrity of this document Chandigarh
CRM-M-38058-2026 3 bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case.
7. However, it is made clear that in case petitioner is found indulged in any other offence including of similar nature, the prosecution would immediately move an application before this Court for recalling/cancellation of the present bail
order because of misuse of the concessional relief. Needless to observe that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly.
8. Any of the discussion done and recorded here above, shall not be construed as an expression of opinion on the facts of the case.
