Namkum, District Ranchi, Jharkhand. … … Respondents ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Mel Prakash Tirkey, Advocate For the Respondent(s): Mr. Ankit Kumar, AC to SC-I ------ 02/ 07.04.2026 By filing this writ petition, the petitioners have prayed for the following reliefs:- “For issuance of an appropriate writ(s)/ order(s)/ direction(s) issuance of writ in the nature of mandamus commanding upon the respondent authorities to dispose the representation of the petitioners submitted before the respondent No.4 at regular interval lastly it was submitted on 07.01.2026 (Annexure-5) with respect to the correction of the names in register-II of the land 2026:JHHC:9857 2 record of Khata no. 03, 21, and 24 of Mauja Hethdahu, P.S. 262 Circle Namkum, this was necessitate because all the ancestors whose names mentioned in the Register-II have died petitioners are legal heir/ successors of their ancestors. Petitioners belong to the Scheduled Tribe Community and it is the foremost duty of the state to safeguard the interest of the tribal people, in this regard application made before the Respondent no.4 should be disposed as per the law.” 2. Heard learned counsel representing the petitioners and learned counsel representing the respondents. 3. It is the case of petitioners that after the death of their ancestors, the land record needs to be corrected and the petitioners be substituted, as the petitioners claim themselves to be the successors of their ancestors, whose names originally stood recorded in Khata Nos.03, 21, and 24 of Mauja Hethdahu, P.S. 262 Circle Namkum. 4. The petitioners’ grievance is that the petitioners have applied before the Circle Officer, Namkum, but no action has been taken, thus they pray that a direction be given to the Circle Officer, Namkum, to dispose the application of the petitioners. 5. Learned counsel representing the respondents submits that if the application of the petitioners has not yet been disposed of, the Circle Officer, Namkum, will pass an appropriate order. 6. Considering the aforesaid submission, the petitioners are directed to approach the respondent – Circle Officer, Namkum, by filing a fresh representation along with all relevant documents, within 2026:JHHC:9857 3 four weeks. 6.1. On receipt of such representation, the Circle Officer, Namkum, will consider the case of the petitioner and if the Circle Officer concludes that name of the petitioners needs to be incorporated in the land records, he will pass a reasoned order, within eight weeks from the date of receipt of copy of this order along with the representation, and communicate the same to the petitioners. 6.2. If the claim of the petitioners has been rejected for any reason, the same shall also be communicated to the petitioners. 7. With the aforesaid direction, this writ petition stands disposed of.
