CRM(NDPS) 1514 of 2026 Dismissed An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Galsi P.S. Case No.204 of 2025 dated 15.04.2025 under Sections 21(c)/25/29 of the NDPS Act. And In the matter of: Chandan Debnath … petitioner
Mr. Debarshi Brahma Mr. Sayantan Maity Mr. Subarna Banik
… for the petitioner
Mr. Amitabha Karmakar
Ms. Nabanita Chatterjee
… for the State
Learned advocate appearing for the petitioner refers to the earlier direction passed by this Court in CRM(NDPS) 240 of 2026 and submits that there has been no progress of the trial. Learned advocate appearing for the State opposes the prayer for bail and submits that there has been recovery of 10,000 bottles of phensedyl. The petitioner is in custody for more than 1 year 3 months. However, whether the earlier direction passed by this Court was communicated to the special court, is not reflected from the records of the case. Accordingly, the trial court would adhere to the earlier direction passed on 11.02.2026 in CRM(NDPS) 240 of 2026.
2 At this stage, I am not inclined to release the petitioner on bail. Learned advocate for the State would communicate this order to the special court. Thus, CRM(NDPS) 1514 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
