This Civil Writ Petition is being filed under Articles 226/227 of the Constitution of India for the issuance of an appropriate writ, order or direction, particularly a writ in the nature of Certiorari, for quashing/expunging the adverse Annual Confidential Report (ACR) entries for the year 2022–23 (Annexure P-14), recorded by respondent No. 4 and communicated to the petitioner vide communication dated 18.06.2025 (Annexure P-13), whereby the petitioner's integrity has been recorded as "doubtful" and he has been graded as having "poor knowledge of Rules", PARUL VERMA 2026.07.21 10:26 I attest to the accuracy and authenticity of this order/judgment. 2 CWP-16691-2026 "poor drafting", and being "not fit for promotion"; and further for the issuance of a writ in the nature of Mandamus directing the respondents to substitute the aforesaid adverse entries with an appropriate grading commensurate with at least "Very Good", along with all consequential service benefits. The petitioner also prays for staying the operation and effect of the impugned adverse ACR entries during the pendency of the present writ petition. 2. At this stage, learned counsel for the petitioner confines the prayer to the limited extent that the petitioner would be satisfied if his representation dated 09.07.2025 (Annexure P-16) is decided by respondent No.2/ competent authority keeping in view judgment rendered by Division Bench of this Court in State of Haryana and others v. Rani Devi, LPA No.547 of 2021, decided on 28.05.2025 by passing a speaking order within a time-bound period. 3. Learned State counsel, appearing on advanced notice, submits that he has no objection in case a direction is issued to the respondent No.2/competent authority for time-bound consideration and decision of the representation dated 09.07.2025 (Annexure P-16) of the petitioner by passing a speaking order. Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondent No.2/competent authority is directed to consider the representation dated 09.07.2025 (Annexure P-16) of the petitioner keeping in view judgment rendered by Division Bench of this Court in State of Haryana and others v. Rani Devi, LPA No.547 of 2021, decided on 28.05.2025 and pass a speaking order, after affording him an opportunity to be heard, within a period of 02 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by the respondent. 5. Disposed of, accordingly.
